Preamble: The general sales conditions (GSC) of the brand Mauliébris Paris govern the use of the Internet site of the brand and the commercial transactions carried out on this site. By placing an order on the Mauliébris Paris website, the customer acknowledges having read and accepted these terms and conditions in their entirety.

Customer: non-trading natural person who places an order and has full legal capacity.

Order: commitment to purchase all items selected by the customer via the site's e-commerce service.

Prices: The prices of items displayed on the site are in euros and include value-added tax (VAT), but do not include customs duties and other taxes, shipping costs within and outside mainland France, and any currency conversion charges depending on the payment method chosen by the customer. Prices include any discounts applicable at the time of ordering. Any new tax or contribution, notably environmental, may be added to the selling price of the items. Mauliébris Paris reserves the right to modify the prices of items at any time, and items will be invoiced according to the prices in force at the time of validation of each order, subject to availability. The price of items invoiced to the customer will be that indicated in the order confirmation sent by e-mail. Creating a customer account : In order to place an order on the site, the customer must first create an account containing his/her identification data (the "account"). The creation of an account is reserved for non-trading individuals, aged at least 18 and with full legal capacity. The customer's registration on the site is validated by Mauliébris Paris after verification of the standard form completed by the customer, and the customer receives an e-mail confirming registration.

When creating an account, the customer is solely responsible for entering identification data, and undertakes to provide complete, accurate and up-to-date information, without impersonating a third party or concealing or modifying his or her age. If an error occurs in the recipient's details, Mauliébris Paris cannot be held responsible for the impossibility of delivering the items.

The customer also chooses a login (e-mail address) and password when creating an account. If the chosen username is already in use, the system will ask the customer to choose a new one. The login and password are personal and confidential, and the customer is solely responsible for them.

The customer undertakes to keep his password secret and not to divulge it under any pretext whatsoever. In the event of suspicion of use of the login and password by a third party, the customer must immediately inform Mauliébris Paris in order to change the password and/or request closure of the account.

Mauliébris Paris reserves the right to close any account and to refuse any sale to a customer in the following cases: non-payment of one or more previous orders, abusive, unfair or fraudulent use of the ordering service offered on the site or non-compliance with the customer's obligations defined in the general conditions of sale, or previous orders obviously validated by a professional seller customer. In this case, Mauliébris Paris will send an e-mail to the customer concerned at the address provided when the customer's account was created, informing the customer of the deactivation of the customer's login and password, as well as the closure of the customer's account.

Ordering: Ordering on the site is subject to a procedure which includes several stages leading to the validation of the order and involves compulsory payment. 

To place an order on the site Mauliébris Paris, the customer must be of legal age and have legal capacity to contract. The customer declares to be the natural person who opened the account associated with the order. 

Professional sellers are not authorized to place orders on the site, which is reserved exclusively for retail sales and private individuals. The customer must order a quantity corresponding to the average needs of a consumer and may not order more than this. Mauliébris Paris reserves the right to refuse an order obviously validated by a professional seller.

The basket contains a summary of the items selected, their prices and the related charges. The customer may modify the basket before validating the order. Validation of the order confirms acceptance of the GCS, the items purchased, their prices and associated charges. Mauliébris Paris will send an order confirmation e-mail once payment has been confirmed. All orders are subject to prior acceptance by Mauliébris Paris and are not definitively confirmed until an e-mail has been sent confirming shipment of the items. The customer formally accepts the use of e-mail for confirmation by Mauliébris Paris of the contents of his order.

The customer may request the invoice by sending an e-mail to Mauliébris Paris at customercare@mauliebris.com, specifying the order number concerned. In the event of a data entry or transmission error, Mauliébris Paris cannot be held responsible for the non-delivery of the confirmation e-mail and/or the items. Mauliébris Paris reserves the right to remove items from the site or to modify the information contained therein at any time. Despite Mauliébris Paris' best efforts to satisfy its customers, it reserves the right to refuse an order after sending the confirmation e-mail. Mauliébris Paris will not be held responsible for any such decisions.

Payment methods: Mauliébris Paris accepts payment by credit card and other payment methods specified on its website. Full payment is required at the time of order and must be made in euros. Payment details are treated securely and confidentially, in accordance with current laws and regulations. By communicating his/her credit card number to Mauliébris Paris, the customer expressly authorizes the debiting of his/her account for the amount of the items as indicated at the time of order confirmation. If payment is refused, Mauliébris Paris will send an order cancellation notice to the e-mail address provided when registering on the site. The data recorded and kept by Mauliébris Paris serves as proof of the order and all sales made. 

 

Delivery: Delivery means the transfer of physical possession of the item(s) to the customer (the "Delivery"). The risk of loss or deterioration of the item(s) is transferred to the customer at the time of delivery.

Mauliébris Paris undertakes to dispatch products as quickly as possible, unless otherwise indicated on the site. Delivery costs are indicated when the order is placed and may vary depending on the destination and delivery method chosen. 

It is the customer's responsibility to provide a correct address and all the exact and complete information required for the proper routing of the order and delivery (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.) and to ensure that someone is available to receive the products at the address indicated. The delivery address indicated by the customer must be the customer's home address or that of a natural or legal person of the customer's choice. Delivery cannot be made to hotels or post office boxes. 

In the e-mail confirming shipment of the order, the customer receives the tracking number allocated to the parcel, enabling him to follow the delivery process of his order.

Delivery is deemed to have taken place as soon as the order is made available to the customer by the carrier. The control system used by the carrier is authoritative. In the event of impossibility of delivery due to an erroneous delivery address, no reshipment will be made and the customer will be reimbursed within 14 days of receipt of the order by Mauliébris Paris, via the means of payment used at the time of order.

Mauliébris Paris delivers orders within the time limits mentioned in the "deliveries and returns" section of the site, as it exists at the time of the order, and no later than thirty days after the order has been validated. Mauliébris Paris cannot be held responsible for delays in delivery that are not of its making or justified by a case of force majeure (as defined below in article 10 of the GCS).

If the delivery time is exceeded, the customer may write to customercare@mauliebris.com to request the status of the delivery and agree a reasonable additional delivery time. If the customer has not received their order by the end of this new reasonable delivery period, they may cancel the sale by writing to customercare@mauliebris.com and obtain a refund of all sums paid for the order within a maximum of 14 days, using the same means of payment as those used for the order. If the order has already been dispatched at the time of cancellation of the sale, the customer must return it to Mauliébris Paris for reimbursement. To do so, the customer must write to customercare@mauliebris.com as soon as he receives his order, specifying his first name, surname and order number, in order to obtain a prepaid return label. Items must be returned in their original packaging, new and unworn, with all labels intact and attached. Mauliébris Paris cannot be held responsible for any damage resulting from a delay in delivery. Mauliébris Paris will only reimburse the sums paid for the order, to the exclusion of any other form of compensation.

Right of withdrawal and refund :

Mauliébris Paris recognizes the right of withdrawal of its customers in accordance with current legislation. Thus, if the customer is not entirely satisfied with his purchase, he has the possibility of retracting within 14 (fourteen) calendar days from receipt of his order. After this period of 14 (fourteen) days, the sale is firm and final and no returns are possible.

To exercise his right of withdrawal, the customer must inform Mauliébris Paris in writing, at customercare@mauliebris.com, specifying surname, first name, order number, references of the item(s) to be returned. Products must be returned in their original condition, complete and with all accessories. Return shipping costs are the responsibility of the customer, unless the product is defective or does not conform to the order. Mauliébris Paris will reimburse the customer only if it succeeds in recovering the items originally delivered. Once the returned items have been checked, Mauliébris Paris undertakes to reimburse the customer as soon as possible and at the latest within 14 days of receipt of the return package. Reimbursement will be made using the same method of payment as that used for the order. However, if the customer does not comply with the GCS, Mauliébris Pars will not be able to refund the items. Refunds are made in euros, and any additional costs related to the conversion of foreign currencies are the responsibility of the customer.

 

This return and refund procedure is exclusive of any exchange.

9 . Product warranty and exclusions :

 

The products offered for sale on the website come with legal guarantees of conformity (L.211-1 et seq. of the French Consumer Code) and guarantees against hidden defects (article 1641 et seq. of the French Civil Code), which allow you to return defective or non-compliant products.

Article L.211-4 of the French Consumer Code: The seller is obliged to deliver goods in conformity with the contract, and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter is his responsibility under the contract or was carried out under his responsibility.

Article L.211-5 of the French Consumer Code: To conform to the contract, the goods must :

1° Be fit for the use ordinarily expected of similar goods and, where applicable :

- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;

- have the qualities that a purchaser may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

Article L.211-7 of the French Consumer Code: Defects of conformity which appear within six months of delivery of the goods are presumed to have existed at the time of delivery, in the absence of proof to the contrary.

The seller may rebut this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity.

Article L.211-10 of the French Consumer Code: If repair or replacement of the good is impossible, the buyer may return the good and have the price refunded, or keep the good and have part of the price refunded.

The same option is available to him:

1° If the solution requested, proposed or agreed in application of article L. 211-9 cannot be implemented within one month of the buyer's complaint;

2° Or if this solution cannot be found without major inconvenience for the customer, given the nature of the good and the use he is seeking.

However, the sale cannot be rescinded if the lack of conformity is minor.

Article L.211-12 of the French Consumer Code (Code de la Consommation): Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.

Article 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.

Article 1645 of the French Civil Code: If the seller was aware of the defects, he is liable to the buyer for all damages, in addition to restitution of the price he received.

Article 1646 of the French Civil Code: If the seller was unaware of the defects in the item, he will only be obliged to refund the purchase price and reimburse the buyer for the costs incurred by the sale.

Article 1648 paragraph 1 of the French Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two (2) years of the discovery of the defect. Mauliébris Paris accessories are covered by a one-year warranty for the loss of a crystal, the detachment of a part, the loss or breakage of a spring or metal clip. If the product is more than one year old, or if proof of purchase is not available, a fee of 20 euros (incl. VAT) will be charged. However, even during the warranty period, Mauliébris Paris cannot accept products that are worn, tarnished (by hairspray, for example), rusted, broken or dirty, nor can it replace a missing part. To assess whether your accessory can be repaired, please send photos of the product concerned to customercare@mauliebris.com. Mauliébris Paris reserves the right to determine, at its sole discretion, whether a product is eligible for warranty and to make the necessary repairs or replacements.

The warranty does not cover products that have been altered, repaired, integrated or added to without the seller's authorization. Nor does it apply to apparent defects. 

Liability and force majeure :

 

Hypertext links from the mauliebris.com site to other sites do not incur the liability of the publishing director.

Mauliébris Paris is only liable for direct and foreseeable damage arising from the use of the site or the conclusion of the sales contract with the customer, to the exclusion of any indirect damage.

The responsibility of Mauliébris Paris concerning any item purchased on the site is strictly limited to its purchase price.

Mauliébris Paris will not be held responsible for the following losses, whatever their origin:

  • Loss of income or sales ;
  • Operating loss ;
  • Loss of profits or contracts ;

The customer acknowledges that he/she assumes all risks associated with downloading or obtaining content through the site and agrees to be solely responsible for any damage to his/her computer system or loss of data resulting from such downloading.

The responsibility of Mauliébris Paris is limited to the delivery of articles in conformity with the provisions of the contract. Articles are considered to be in conformity with the contractual provisions when the following conditions are met: (i) they correspond to the description and characteristics indicated on the site; (ii) they are suitable for the usual use of articles of this type; (iii) they respect the standards of quality and durability generally accepted for similar articles and which can reasonably be expected.

Mauliébris Paris cannot be held responsible for any delay or non-performance of its obligations in the event of force majeure. Force majeure includes any event beyond the control of Mauliébris Paris and impeding the normal performance of contractual obligations, such as natural disasters, strikes, labor disputes, fires, floods, acts of terrorism, acts of war, pandemics, industrial accidents, technical failures or network breakdowns.

For the duration of a case of force majeure, the obligations of Mauliébris Paris and the customer are suspended without any compensation being due, and the execution and delivery deadlines will be extended accordingly. Mauliébris Paris will do its utmost to find a solution that will allow the contractual obligations to be fulfilled despite the case of force majeure. If the case of force majeure continues for more than 3 months, the transaction in question may be terminated at the request of Mauliébris Paris or the customer, without any compensation being due on either side. Force majeure does not justify non-payment by the customer.

Proof: Mauliébris Paris implements measures to ensure the security of information provided by customers when purchasing on the site. However, it is important to note that the proof of the transaction, notably concerning orders, payments and communications, is the responsibility of the customer. It is recommended that a copy of all communications and transactions with Mauliébris Paris be retained for future reference.

Personal data protection

The customer is informed and consents to the collection and use of his personal data by Mauliébris Paris, which acts as the data controller in accordance with Law 78-17 of January 6, 1978 relating to data, files and freedoms as amended on January 20, 2017 and as it will be amended by the General Regulation (eu) on data protection 2016/679 dated April 27, 2016 (hereinafter the "Data Protection Act").

Quality guarantee

All Mauliébris Paris products are meticulously handcrafted, using only the finest materials and time-honored skills. We check each product before it leaves our workshop, to ensure that it is in perfect condition. However, in the event of a manufacturing defect, we will repair or replace the defective product, subject to warranty conditions.

Warranty conditions

The Mauliébris Paris warranty covers manufacturing defects in products for a period of one year from the date of initial purchase. The warranty is valid only for the original owner of the product and cannot be transferred to a third party.

The warranty does not cover defects resulting from abuse, neglect, misuse, accident, unauthorized modification, exposure to extreme environmental conditions, or normal wear and tear due to regular use of the product. Nor does it cover damage caused by chemicals, solvents, dyes or other corrosive or abrasive products.

Warranty procedure

If you discover a manufacturing defect on one of our products during the warranty period, please contact us by e-mail at customercare@mauliebris.com, providing the following information: order number, description of the defect, photograph of the defect and proof of purchase. We will assess your warranty claim and provide you with instructions on how to return the product.

Once the product is returned, our team of experts will examine the reported defect and determine whether the product is eligible for warranty. If the defect is covered by warranty, we will repair or replace the faulty product as soon as possible. If the product is not eligible for warranty, we will inform you of the options available, such as a chargeable repair or return of the product at your expense.
